The paid developer tier is governed by the Developer Terms, which supplement this page. See also the Acceptable Use Policy, the Service Level Agreement (draft), and the subprocessor list.
1. Licence Grant
Smarter Weather LLC grants you a personal, non-commercial, non-exclusive licence to access and use the Service for your own weather information needs. Subscribers on a paid developer tier are additionally granted a commercial licence to use the Service within the scope of that tier, subject to the Developer Terms at /developers/terms. In every case, the licence does not convey any ownership of the data or Service and may be revoked as described in these Terms.
2. Platform and Support
The Service includes this website, the SmarterWeather consumer applications, and any APIs or Model Context Protocol (MCP) servers provided. Availability and support for free-tier consumer use are provided on a best-effort basis and are not guaranteed. Support and service levels for paid developer tiers are defined in the Developer Terms and the accompanying Service Level Agreement.
3. Transfer and Sublicensing
You may not transfer, assign, sublicense, resell, or otherwise grant rights to the Service to any third party. This restriction applies to all tiers, including paid developer tiers: a paid developer licence authorises you to build products on top of the Service, but not to resell the raw data or sublicense API or MCP access to others.
4. Fee for Use
Smarter Weather offers multiple tiers. The consumer web and mobile applications are free to use at no charge. Developers accessing the public APIs or MCP servers may use a free developer tier subject to quota and rate limits, or subscribe to a paid developer tier that includes a monthly fee plus usage-based overage charges as described on our pricing pages and in the Developer Terms. Pricing, included quotas, and overage rates are subject to change on notice; material increases will be communicated before taking effect.
5. Data Collection and Privacy
Use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect data for both consumer users and developer account holders.
6. User Accounts and Registration
Smarter Weather supports two account types. A consumer account is optional for basic consumer use of the Service but required for features such as personalised alerts or the Chat experience; consumer accounts are provided by our authentication partner, Clerk. A developer account is required to generate API keys, subscribe to a paid developer tier, or access the public APIs and MCP servers; developer accounts are also provided through Clerk and are subject to the Developer Terms. You are responsible for maintaining the confidentiality of your account credentials, API keys, and OAuth tokens, and for all activity under your account.
7. Commercial Use
Commercial use of the Service or its data is permitted only (a) under a paid developer tier subscription, within the scope defined in the Developer Terms and the Acceptable Use Policy at /developers/acceptable-use, or (b) under a separate written agreement with Smarter Weather LLC. Regardless of tier, resale of raw data, sublicensing of API or MCP access, and use in life-safety-critical deployments without independent verification are prohibited.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. Weather data is inherently uncertain and may be inaccurate or incomplete.
9. Limitation of Liability
To the maximum extent permitted by law, Smarter Weather LLC's total liability for any claim related to the Service is limited to direct damages not exceeding $100.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict of law principles.
11. Force Majeure
Smarter Weather LLC is not liable for delays or failures due to causes beyond its reasonable control, including natural disasters, acts of government, or internet outages.
12. International Use
Use of the Service from outside the United States is at your own risk and you are responsible for compliance with local laws.
13. Severability and Entire Agreement
If any provision of these Terms is found invalid, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Smarter Weather LLC regarding the Service.
